| STANDARD-FORM CONTRACT CONDITIONS K&K Center of Beat leases out samples of photographic works (b/w-prints and slides) with the purpose of granting the right of use; unless specified otherwise, this right is granted on each occasion for one single act of publication only. From the moment of receipt until their return to K&K Center of Beat, the client is liable for the samples being undamaged and complete. The client will return the samples to K&K Center of Beat without express request within the period of lease. This period, unless specified otherwise, has a maximum duration of 30 days from the date of the delivery note. In case of the client's exceeding the period of lease, he agrees to pay a blocking fee of 10% of the handling fee per diem. For material accepted for use an extension of the period of lease may be granted. Any type of use of the samples is subject to a fee. Such fee for the use of photographic material needs to negotioated with K&K Center of Beat prior to such use, and will become payable upon the date of publication. The amount of such fee will depend on the type and extent of use. Any client is required to provide the necessary information. Any further use requires negotiation of a follow-up fee. Compilation of photo samples is subject to a handling fee which will depend upon the amount and type of work required. All quoted prices are inclusive VAT within Germany. | |||

Handling fees are not part of the leasing fee and therefore cannot be deducted from the final leasing fee which will become payable upon use. Compensation for lost or damaged photo material will usually be settled as a lump-sump. We reserve further claims if applicable. Payment of compensation does not constitute any transfer of ownership or rights of use. | |||

Futhermore, all additional right are reserved. Any use of samples is subject to the stipulations of copyright laws. Slides will be delivered in sealed wrappers. Opening the wrappers without subsequent publication will incur a layout fee (Euro 50,00 per photo). This layout fee may be deducted from the respective publication fee, if the photo is published later. The client is required to make arrangements for unequivocal identification of copyright owner and agency, in a way which prevents any doubt about such information pertaining to a certain photo. Omission of such photo and copyright information will incur a surcharge of 100% of the agreed publication fee. Upon publication, the client will supply to K&K Center of Beat 2 free copies of the publication. K&K Center of Beat conducts its business according to the current version of the recommendations of the "Mittelstandsgemeinschaft Foto-Marketing". Upon receipt of sampled offers and these standard-form contract conditions the client is deemed to automatically accept the latter. Place of jurisdiction and location of debts are Hamburg.
